An employee who is injured while commuting to or from work is not eligible for WC benefits since the employee is not “rendering any service to the employer” during a typical commute, with exceptions. WebThe “going and coming” rule has its roots in the common law and states that an injury occurring while an employee is traveling to and from work is not compensable. An injury must arise out of and in the course of employment in order to be compensable under the North Carolina Workers’ Compensation Act.
